1. Acceptance of Terms
By accessing or using ParseBounce ("the Service"), operated by Epic Solutions Limited, a company registered in Scotland, United Kingdom ("the Company", "we", "our", or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
2. Description of Service
ParseBounce is an email delivery platform that provides two core capabilities:
- Bounce Tracking: Monitoring bounces, complaints, deliveries, and other email events from providers including AWS SES, SendGrid, Mailgun, SparkPost, Postmark, and Mandrill via webhook integration. The Service processes these events and provides analytics, suppression management, and alerting capabilities.
- Email Sending: Sending transactional and campaign emails through your own email provider credentials or through ParseBounce's built-in sending infrastructure, with contact management, list segmentation, and template editing.
3. Account Registration
To use the Service, you must create an account. You agree to:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activities under your account
4. Subscription and Billing
ParseBounce offers subscription plans with tracking and sending limits:
- Free Plan: 200 tracked events/month, 100 sent emails/month, 1 project, 1-day retention
- Personal Plan: 10,000 tracked events/month, 5,000 sent emails/month, 2 projects, 7-day retention
- Pro Plan: 50,000 tracked events/month, 25,000 sent emails/month, 5 projects, 30-day retention
- Business Plan: 200,000 tracked events/month, 100,000 sent emails/month, 20 projects, 90-day retention
- Enterprise: Custom limits and features
Paid subscriptions are billed monthly or annually. You may cancel at any time, and your subscription will remain active until the end of your current billing period. No refunds will be issued for partial billing periods.
All payments are processed securely by Stripe on behalf of Epic Solutions Limited. Prices are displayed in USD or EUR and are exclusive of any applicable taxes unless otherwise stated.
5. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose
- Send spam, unsolicited bulk email, or messages that violate CAN-SPAM, GDPR, or other applicable anti-spam legislation
- Send emails to purchased, rented, or scraped email lists
- Attempt to gain unauthorized access to the Service or its systems
- Interfere with or disrupt the Service
- Resell or redistribute the Service without authorization
- Use the Service to send phishing emails, malware, or other harmful content
- Violate any applicable laws or regulations
We reserve the right to suspend or terminate your account immediately if we determine, in our sole discretion, that you are using the Service in violation of this section.
6. Email Sending Responsibilities
When using the email sending features of the Service, you are solely responsible for:
- Ensuring all recipients have given valid consent to receive your emails
- Complying with all applicable email marketing laws (CAN-SPAM, GDPR, PECR, CASL, etc.)
- Including accurate sender information and a working unsubscribe mechanism
- Maintaining clean and up-to-date contact lists
- The content of all emails sent through the Service
If you use your own email provider credentials ("Bring Your Own Account"), you are additionally responsible for complying with your provider's terms of service and acceptable use policies.
7. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your data as described therein.
8. Aggregated Data and Global Intelligence
To improve email deliverability for all users, ParseBounce may collect, analyze, and utilize anonymized and aggregated data from email events processed through the Service:
- What we collect: Anonymized patterns such as bounce rates, complaint rates, and delivery statistics associated with email domains and cryptographic hashes of recipient addresses (not the actual email addresses).
- How we use it: To identify problematic email addresses and domains, detect disposable email services, and provide deliverability insights that benefit all ParseBounce users.
- What we never share: Your recipients' actual email addresses, message content, sender information, or any data that could identify you or your recipients individually.
- Industry standard: This practice is common among email deliverability services and helps protect all users from spam traps, invalid addresses, and other email delivery issues.
9. Intellectual Property
The Service, including its design, features, and content, is owned by Epic Solutions Limited and protected by intellectual property laws. You retain ownership of your data but grant us a license to process it as necessary to provide the Service.
10. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We shall not be liable for any loss or damage arising from Service downtime.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Epic Solutions Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill arising from your use of the Service.
Our total aggregate liability arising out of or in connection with these Terms or your use of the Service shall not exceed the total amount paid by you to us in the twelve (12) months preceding the event giving rise to the claim.
12. Indemnification
You agree to indemnify and hold harmless Epic Solutions Limited, its directors, officers, and employees from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights, including intellectual property rights and privacy rights.
13. Termination
We may suspend or terminate your account if you violate these Terms. You may also terminate your account at any time. Upon termination, your right to use the Service will cease, and your data may be deleted according to our data retention policies. Sections 11, 12, and 15 shall survive termination.
14. Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Service.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Scotland and the United Kingdom. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Scotland.
